"Criminal law --- Charter of Rights and Freedoms — Charter remedies [s. 24] — Stay of proceedings Accused was charged with various charges, and during course of arrest, he sustained multiple abrasions and injury to his face, as well as puncture wound injuries to his left arm, which were caused by police dog
— One of officers wore body camera, which captured interaction between accused and officers, and accused had asked to go to hospital and was transported to police station instead, and accused was transported to hospital several hours after he arrived at station — Accused brought successful application for order that his rights under ss. 7 and 12 of Canadian Charter of Rights and Freedoms were violated — Trial judge found that accused suffered needlessly both physically and psychologically from point of his placement in police car, in which he was transported to station, and in his incarceration at station, which resulted in delay in transporting accused to hospital Every officer who came into contact with accused from point of his cursory examination by paramedics at scene to point he was transported to hospital breached duty of care owed by police to provide necessaries of life — Accused brought application pursuant to s. 24(1) of Charter for stay of proceedings based on breach of his ss. 7 and s. 12 rights
