Headnote Criminal law --- Offences against the administration of law and justice — Corruption — Breach of trust by public officer Accused was passport officer in government office — Accused was contacted by individual, who asked her to meet with passport applicants bypassing regular queueing process in office — Applicants were not who they claimed to be on issued passports Accused approved all passports, including one of individual under another name — Accused was charged with breach of trust, as well as four related counts — Accused claimed she was not knowing participant in individual's scheme — Individual testified against accused at trial, after pleading guilty to his role in scheme — Accused was tried on all charges — Accused convicted Accused was aware of fraud taking place — Individual had reason to obtain fraudulent passport, having been recently deported from USA — Video footage showed other individuals being directed to accused's counter in office — Accused did not follow proper procedures in issuing fraudulent passports — Although all evidence was circumstantial, taken as whole only conclusion was that accused knowingly breached her trust — Accused's participation was necessary to scheme — Accused knew or ought to have known that applicants would use passports illegally, once in receipt of them — All elements of breach of trust and related offences were made out Criminal Code
