Criminal law --- Charter of Rights and Freedoms — Unreasonable search and seizure — Authorized by law Search of motor vehicle conducted incidental to investigative detention was not pursued with safety of officer in mind and was unlawful breach of s. 8 of Charter — Trial judge did not give due regard to investigating officer's absence of good faith — Real evidence convicting accused of possession of controlled substance for purposes of trafficking was procured by unlawful search and should have been excluded under Charter s. 24(2).
